There is no reason he couldn't go to the police about it and they would press charges against her. There was no reason for him to kill her.
No the murder would not be considered justified in the eyes of the law.
First, his life was not currently in immediate jeopardy. If she was coming at him with a knife or something, then it would have been self defense. That wasn't the case, so it's still considered murder. In most states it wouldn't be first degree murder, so the punishment wouldn't be as severe.
Second, the man is partially at fault for not using a condom. I don't care if the woman says she's on birth control...ALWAYS USE A CONDOM.
Third, transmission of AIDS from a woman to man is less likely than the other way around. It's quite possible he didn't even contract the virus from her at all.
Fourth, even if he DID contract the virus, that doesn't mean he's actually got AIDS. Many people carry the virus yet do not have AIDS. Even those that DO develop AIDS, it's not necessarily a death sentence. With good medical care it's possible to live quite a long time.
Since he killed her, he can't sue her for his medical bills, so that wasn't a very well thought out plan was it?
* Under the law it is still a murder but there are mitigating circumstances and this man will get a reduced sentence because he has a mitigating defence.
* It is actually a serious crime to sleep with someone without telling them you have Aids.
No. The man must have been willing and must not have been safe. There would be a chance he would be all right. Sounds like he would have killed her if he got her pregnant too. He deserves jail.
She might have deserved it but the man isn't the judge and jury which is a constitutional law. He's guily of murder.

I would probably try to get her into prison so that I wouldn't have to go.

Besides, not telling your partner that you have aids and giving it to them is not something to take light of. Some states consider it "attempted homicide" while others consider it "premeditated murder".

If he had killed her while they were having sex he could have argued self-defense. As it stands, it was probably a crime of passion and he should be able to plead temporary insanity.
Its never justified to murder anyone,although one can understand the strong emotion. Its not going to achieve anything murdering.the girl. They should have been more careful who they slept with.
This is the story. A woman with Aids sleeps with five men.( none of them new she had Aids). When she gets to the fifth man after they are done having sex she breaks the news to him she has Aids. The man kills her. Was it justified. After all she killed him to and all the men before him. FYI the man did go to jail.
